Scan To Pay Privacy Policy

This Privacy Policy (“Privacy Policy”) is an integral part of our Terms of Service and governs the collection and processing of all faculty, staff, students’, and third-party visitors’ (each, individually, “You” or “User”) data by NAYAX LLC (together with its company affiliates and subcontractors, collectively, “Nayax”) in connection with the Service and the Scan to Pay made available to you by Montclair State University (the “University”). Any terms used herein and not defined shall have the meaning ascribed to them in the Terms of Service.

This Privacy Policy explains what information Nayax may collect from Users, how such information may be used or shared with others, how Nayax safeguards it and how Users may exercise their rights related to their Personal Information (as such term is defined below), among others, according to the California Consumer Privacy Act (“CCPA”), where applicable. If You choose to use, interact with, register or provide data to Nayax or through the Services, you explicitly agree to the use of such data in accordance with this Privacy Policy. You may not use the Services or submit any data through the Services if you do not agree to any of the provisions hereunder. This Privacy Policy shall not be construed in any manner to derogate from the Terms of Service.

You are not required by law to use the Services and provide the University and Nayax with any Personal Information. Using the Services to sharing Personal Information with the University and Nayax is entirely voluntary.

What is Personal Information and what data is collected about You BY NAYAX?

Personal Information”, means any information which identifies or can be used to identify a natural person,  including, but not limited to, first and last name, phone number, email address, online identifiers, IP address, billing information (such as credit card number), information concerning households, devices etc.

Personal Information is only used for limited purposes, as specified below and in the Nayax Privacy Policy.

Payment for parking services

In order to use the Services, you will be asked to scan a designated QR code with your mobile device, which will lead you to a landing page where you will be required to provide the following information in order to pay for parking:

A unique identification number which can be either your ticket number (the number appears on your parking ticket), your car license plate or phone number. Please note, the identification number may vary from each parking lot.

As well as your payment method (credit card, e-wallet, debit, etc.), total payment amount, and payment details (partial number of your credit card, as required under applicable laws and regulations

Nayax will be processing the following data associated with your parking details: location name (the parking lot name),  time of parking at the location.

To process payment for the parking time.

To resolve any disputes, communicate with you regarding customer service and support issues, and to respond to questions or comments and help resolve any problems.

To improve the Services, and to develop new features, products and services, subject to applicable laws, rules, regulations, and contractual obligations.

   Technical Information and Online Identifiers & Cookies

When you use the Service, Nayax logs your IP address. Nayax collects additional online identifiers via cookies placed on your browser. Such information includes the type of the visitor’s operating systems, type of browser, access time and date, user’s click-stream, visitor’s actions on the website, browsing data (e.g., directing URL’s), search queries, and approximate location. Nayax collects technical information transmitted by your device when using the Services.

Most browsers will allow you to erase cookies from your computer’s hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. In addition, subject to applicable laws, rules, regulations, and contractual obligations, Nayax may use certain Personal Information to prevent potentially prohibited or illegal activities, fraud, misappropriation, infringements, identity thefts and any other misuse of the website or the Services, as well as to protect the security or integrity of its databases, website and the Services, and to take precautions against legal liability. Additionally, Nayax may also use Personal Information to comply with any applicable law and assist law enforcement agencies and competent authorities in connection therewith.

Sharing Personal Information with third parties

Nayax may shares Personal Information only as specified in the Nayax Privacy Policy.

Users' rights with respect to Personal Information

Depending on your jurisdiction, data protection and privacy laws provide you with the ability to exercise certain rights regarding your Personal Information that the University or Nayax processes. Please note that, unless you instruct the University and/or the Nayax otherwise, subject to all applicable laws, the University and/or Nayax may respectively retain the information collected in connection with your use of the Service for as long as needed to provide the Services and to comply with our legal obligations, resolve disputes and enforce our agreements. If you object to the aforesaid collection, use and sharing of data, please immediately cease using the Services.

California law grants consumers certain rights and imposes restrictions on particular business practices. See the applicable section listed in the Privacy Link above for more information about Nayax’s policies and procedures in furtherance of such rights and restrictions.

Is Personal Information regarding children collected by the university or nayax in connection with the service?

The Service is a general audience Service which is not directed to persons under 18 years old or equivalent minimum age for providing consent to processing of Personal Information in the relevant jurisdiction (“Child”). Neither the University nor Nayax knowingly collects or solicits Personal Information from a Child. If either the University or Nayax becomes aware that a Child has provided either party with Personal Information, the recipient of such information will delete such data from its databases.

How my information is being protected?

We implement measures to reduce the risks of damage, loss of information and unauthorized access or use of information in accordance with the applicable law. However, these measures are unable to provide absolute information security. Therefore, although efforts are made to secure your personal information, it is not guaranteed and you cannot reasonably expect that the Service and its related databases will be immune from any wrongdoings, malfunctions, unauthorized interceptions or access, or other kinds of abuse and misuse.

The University may, at any time and from time to time, modify this Privacy Policy regarding your use of the Services. Modifications to this Privacy Policy will be posted on the website and shall be effective as of the date on which they are posted on the website.
